Who issues permits for the extraction of hunting resources to individual hunters?
Letter of the Ministry of Finance of the Russian Federation dated April 25, 2011 N 03-06-06-03/4 explains that, according to Art. 333.1 ch. 25.1 "Fees for the use of objects of the animal world and for the use of objects of aquatic biological resources" of the Tax Code of the Russian Federation (hereinafter referred to as the Code), organizations and individuals, including individual entrepreneurs, who, in accordance with the established procedure, receive permission to extraction of objects of the animal world on the territory of the Russian Federation.
According to the procedure for issuing permits for the extraction of hunting resources, established by the Federal Law of July 24, 2009 N 209-FZ "On hunting and on the conservation of hunting resources and on amendments to certain legislative acts of the Russian Federation" (hereinafter - Law N 209-FZ), the issuance permits for the extraction of hunting resources for individuals hunting in public hunting grounds are issued by the executive authority of the constituent entity of the Russian Federation, and when hunting in assigned hunting grounds (hunting grounds that are used by legal entities and individual entrepreneurs on the basis of hunting agreements) - by a legal entity and an individual entrepreneur who has concluded hunting management agreements with the executive authorities of a constituent entity of the Russian Federation.
At the same time, paragraph 2 of Art. 31 of Law N 209-FZ establishes that the issuance of permits for the extraction of hunting resources is carried out by legal entities and individual entrepreneurs who have entered into hunting agreements, at their request, by public authorities within their powers, defined in accordance with Art. Art. 32 - 34 of Law N 209-FZ, forms of permits for the extraction of hunting resources are provided for subsequent issuance of such permits to natural persons - hunters.
Who and in what terms should provide information on the obtained permits for the extraction of wildlife objects to the tax inspectorate? What is this information?
In accordance with Art. Art. 333.6 and 333.7 of the Code, bodies issuing permits in accordance with the established procedure for the extraction of objects of the animal world, no later than the 5th day of each month, submit to the tax authorities at the place of their registration information on the issued permits, the amount of the fee payable for each permit, as well as information on the terms of payment of the fee, and organizations and individual entrepreneurs that use wildlife objects under a permit for the extraction of wildlife objects submit to the tax authority at the location of the authority that issued the said permit, information on the obtained permits for the extraction of wildlife objects, the amount of the fee, payable, and the amounts of fees actually paid no later than 10 days from the date of receipt of such permission.
In what form is information about issued permits submitted?
According to the form approved by the Order of the Federal Tax Service of Russia dated February 26, 2006 N SAE-3-21 / 108@ "On approval of the form of information on issued permits for the extraction of hunting resources, the amounts and terms of payment of the fee for the use of wildlife objects."
Should a hunter submit information about the obtained permit for the extraction of hunting resources to the tax office?
An individual entrepreneur who has received, in accordance with the established procedure, a permit for the extraction of objects of the animal world, who is not an individual entrepreneur who has entered into a hunting agreement for the extraction of objects of the animal world, must not submit information about the obtained permits to the tax authorities. The procedure for submitting information on the obtained permits to the tax authorities for the extraction of objects of the animal world individuals- Citizens who are not individual entrepreneurs are not provided for by the Code.
What information is indicated in the permit for the extraction of hunting resources?
According to clause 16 of the Procedure for issuing permits for the extraction of hunting resources, approved by Order of the Ministry of Natural Resources of Russia dated April 23, 2010 N 121 "On approval of the procedure for issuing permits for the extraction of hunting resources and the form of a permit for the extraction of hunting resources", when issuing and issuing a permit by an executive authority , a legal entity, an individual entrepreneur, the following information is indicated in the permit.
1. Surname, name, patronymic of the hunter.
2. Data of the main identity document of the hunter.
3. Name and legal form of the legal entity, last name, first name, patronymic of the individual entrepreneur, whose employee is the hunter, as well as the contact phone number, postal address and (or) e-mail address by which communication with this legal entity, individual entrepreneur (information is indicated if the applicant is an employee of a legal entity, an individual entrepreneur who performs duties related to hunting and preserving hunting resources on the basis of an employment or civil law contract).
4. Date of issue of the hunting license and its accounting series and number.
5. The type of hunting that is supposed to be carried out.
6. Information about the extracted hunting resources.
7. Quantity of the extracted hunting resources.
8. Dates of hunting and places of hunting.
Clause 20 of the Procedure for issuing permits for the extraction of hunting resources, approved by Order of the Ministry of Natural Resources of Russia dated April 23, 2010 N 121, establishes that the issuance of a permit is carried out on the basis of a hunting ticket presented by an individual, a main identity card, and a document confirming the payment of a fee for the use of objects animal world.
What should organizations and individual entrepreneurs do with unrealized permits?
At the same time, after the expiration of the permit for the extraction of wildlife objects, organizations and individual entrepreneurs have the right to apply to the tax authority at the location of the authority that issued the said permit, for offsetting or refunding the amount of the fee for unrealized permits for the extraction of wildlife objects issued by the authorized body, carried out in the manner prescribed by 12 of the Code, subject to the submission of documents, the list of which is approved by the federal tax authority.
What does the Federal Tax Service do to administer the fee for the use of wildlife objects, while hunters - individuals are not required to submit information about the permits received to the tax authority?
The Federal Tax Service of Russia in accordance with the Letter of the Ministry of Finance of the Russian Federation dated August 31, 2010 N 03-06-05-03 / 9 in order for the tax authorities to administer the fee for the use of wildlife objects until the relevant changes are made to Ch. 25.1 of the Tax Code asks the Ministry of Natural Resources of Russia to assist in obtaining at the territorial level from the licensing authorities to the tax authorities information on permits issued by legal entities and individual entrepreneurs to individuals, the amount of the fee payable under each permit, and the timing of payment of the fee. At the same time, the Federal Tax Service of Russia proposes to provide information on permits issued by legal entities and individual entrepreneurs in the form approved by Order of the Federal Tax Service of Russia dated February 26, 2006 N SAE-3-21 / 108@.

- The list of methods for obtaining objects of the animal world, classified as objects of hunting, permitted for use.

RULES FOR PROCESSING ANIMAL OBJECTS RELATED TO HUNTING OBJECTS

1. These Rules establish the procedure for obtaining objects of the animal world classified as objects of hunting (hereinafter referred to as objects of the animal world).
2. These Rules do not apply to relations related to the extraction of wildlife objects that are located in specially protected natural areas, as well as the extraction of which is carried out in order to regulate their numbers, scientific, cultural, educational, educational, recreational and aesthetic purposes.
The extraction of wildlife objects for the purpose of amateur and sport hunting is carried out in compliance with these Rules in hunting grounds in accordance with a permit (permit) (hereinafter referred to as the permit) issued by:
- public hunting organizations, other legal entities and individuals - for hunting in the lands in which the hunting economy is maintained by these public hunting organizations, other legal entities and individuals;
- executive authorities of the constituent entities of the Russian Federation exercising the powers to protect, control and regulate the use of wildlife objects and their habitat - for hunting in other hunting grounds.

3. The terms used in these Rules mean the following:
A)"acquisition of objects of the animal world" - hunting, including stalking for the purpose of production, pursuit and the very extraction of objects of the animal world that are in a state of natural freedom, as well as being in the natural habitat of objects of the animal world with a loaded uncovered hunting weapon;
b)"tools for obtaining objects of the animal world" - tools determined in accordance with the list of tools for obtaining objects of the animal world, approved by Decree of the Government of the Russian Federation of January 10, 2009 N 18;
V)"hunting ticket" - a certificate for the right to hunt, confirming that citizens engaged in the extraction of wildlife objects have certain knowledge of hunting, safety precautions for hunting and handling tools for obtaining wildlife objects and skills in these areas;
G)"hunting weapons" - hunting weapons defined by the Federal Law "On Weapons";
e)"products of obtaining objects of the animal world" - the obtained objects of the animal world, as well as meat, skins (skins), horns, bird eggs, down, feathers, internal organs and other parts of their bodies obtained from them;
e)"method of obtaining objects of the animal world" - a set of actions aimed at obtaining objects of the animal world;
and)"term for obtaining objects of the animal world" - the established period of time during which certain types of objects of the animal world can be obtained.
4. The following have the right to obtain objects of the animal world:
A) citizens of the Russian Federation who have received a hunting license in accordance with the procedure established by the Ministry of Agriculture of the Russian Federation. The extraction of wildlife objects is carried out for the purposes of amateur and sport hunting until July 1, 2011 also by citizens of the Russian Federation who have membership hunting cards issued by public hunting organizations in the prescribed manner, including membership hunting cards issued earlier in accordance with the Decree of the Government of the Russian Federation Federation of July 26, 1993 N 728 "On amateur and sport hunting in the Russian Federation";

b) foreign citizens who have received permission to obtain wildlife in the manner prescribed by the Ministry of Agriculture of the Russian Federation.
5. The procedure for issuing, replacing and canceling hunting tickets, as well as permits for foreign citizens to obtain wildlife objects is established by the Ministry of Agriculture of the Russian Federation.
6. The extraction of objects of the animal world, the removal of which from their habitat without a license is prohibited, is carried out under a nominal one-time license for the use of objects of the animal world, issued by the executive authority of the constituent entity of the Russian Federation, exercising the authority to protect, control and regulate the use of objects of the animal world and their habitat (hereinafter referred to as the license). The procedure for issuing, processing and the form of a license are established by the Ministry of Agriculture of the Russian Federation.
The extraction of objects of the animal world, the removal of which from their habitat does not require a license, is carried out on the basis of a hunting license in compliance with the norms, quotas and limits for the extraction of objects of the animal world established in accordance with the legislation of the Russian Federation, within the terms of obtaining objects of the animal world, approved by the Government Decree of the Russian Federation dated January 10, 2009 N 18.

When obtaining objects of the animal world, persons are required to have a hunting license, a permit, as well as a license in the case established by paragraph one of paragraph 6 of these Rules.

When obtaining objects of the animal world with the use of weapons, persons are also required to have a weapon permit in accordance with the requirements of the legislation of the Russian Federation on weapons.
When transporting products for the extraction of objects of the animal world, it is necessary to have a license with you in the case established by paragraph one of paragraph 6 of these Rules, which is a document confirming the legality of obtaining the specified products.
8. The extraction of objects of the animal world can be carried out both by one person (individually) and by a group of persons (group extraction of objects of the animal world - 2 or more people).
9. In case of group catching of wild ungulates and bears, the license must be held by the person responsible for the group catching, and in case of individual catching of objects of the animal world - by the person directly carrying out their catching.
10. Person responsible for group hunting of wild ungulates and bears:
A) upon receipt of a license, checks the correctness of its registration;
b) before acquiring objects of the animal world, checks with all persons participating in their group acquiring, the availability and validity of hunting tickets and permits of internal affairs bodies for the storage and carrying of hunting weapons and does not allow persons who do not have these documents to participate in their acquiring;
V) draws up a list of persons participating in the group procuring of objects of the animal world (hereinafter referred to as the list of persons), indicating:
- dates and places of obtaining objects of the animal world;
- license number, on the basis of which the extraction of objects of the animal world will be carried out;
- type of animal world object to be obtained;
- last name, first name and patronymic of a citizen participating in the extraction of objects of the animal world;
- numbers of a hunting license of a citizen participating in the extraction of objects of the animal world;
- numbers of permission of the internal affairs bodies for the storage and carrying of hunting weapons issued to a citizen participating in the extraction of objects of the animal world;
G) conducts briefings with persons participating in the group hunting of wildlife objects on the safe handling of hunting firearms during group hunting, as well as the procedure for obtaining wildlife objects, after which the person participating in the group hunting of wildlife objects signs the list persons;
e) during the period of group obtaining of objects of the animal world, has a list of persons with him;
e) after obtaining an object of the animal world before the start of its cutting and (or) export (removal), makes a note on the extraction and fills out a license;
and) in the event of an injury to an object of the animal world, before the start of further prosecution, makes a note in the license about the injury and organizes the further extraction of the wounded object of the animal world, for which one day is allotted, not counting the day of injury, otherwise fills in the license, indicating that the object of the animal world was not obtained was.
11. A person participating in the group hunting of wild ungulates and bears must have the documents provided for in paragraph 7 of these Rules.
12. In case of group catching of objects of the animal world, not specified in paragraph 9 of these Rules, a list of persons is not compiled.
13. When extracting objects of the animal world that are not specified in paragraph 9 of these Rules, the removal of which from their habitat without a license is prohibited, the license is filled before the start of transportation of the products of extraction.
14. In case of individual extraction of objects of the animal world, the removal of which from their habitat without a license is prohibited, the license is filled in in accordance with subparagraph "e" of paragraph 10 and paragraph 13 of these Rules.
15. Cub cubs of the current year of birth and female bears with cubs of the current year of birth are not taken before entering the den.
When harvesting bears during and in the place of their winter hibernation (in a den), in the case of several bears in one den, all bears are hunted.
16. Hunting dogs and birds of prey can be used to obtain objects of the animal world.
The extraction of objects of the animal world with dogs is carried out within the terms of obtaining objects of the animal world, classified as objects of hunting.
Training (nataska and nataska) of dogs of hunting breeds is carried out in accordance with the terms of obtaining objects of the animal world, classified as objects of hunting.
Year-round training (training, driving) of hunting dogs is carried out in specially equipped places within the boundaries of territories provided to legal entities or individual entrepreneurs, in accordance with a long-term license for the use of wildlife objects.
17. The executive authority of the subject of the Russian Federation, exercising the powers to protect, control and regulate the use of wildlife objects and their habitat, in agreement with the Ministry of Agriculture of the Russian Federation, has the right to adjust the timing of obtaining wildlife objects within 2 weeks earlier or 2 weeks later than the established terms, taking into account changes in the timing of migration and reproductive cycles of animals due to changes in climatic conditions in a particular year.
18. Citizens belonging to the indigenous peoples of the North, Siberia and the Far East, to ethnic communities whose original culture and way of life include traditional methods of protection and use of wildlife objects, and their associations have the right to obtain wildlife objects in the territories of traditional settlement and economic activities during the calendar year.
19. Persons guilty of violating these Rules are liable in accordance with the legislation of the Russian Federation.

- The division of the subject of the Russian Federation into southern, central and northern regions in terms of the timing of the extraction is carried out by the appropriate specially authorized state body of the subject of the Russian Federation for the protection, control and regulation of the use of wildlife objects classified as hunting objects and their habitat.

- Swamp-meadow game includes snipes, snipes, harshneps, turukhtans, herbalists, lapwings, tules, khrustans, snails, godwit, curlews (charadriiformes), corncrakes, morotuks, turnstones, shepherdesses, common chaps and moorhens (shepherds).
- Waterfowl include geese, goose, ducks (ducks) and coots (shepherds).

- Coralization - a method of obtaining wild reindeer by moving (corralling) a herd from its natural habitat to a specially fenced area of \u200b\u200bthe territory (koral), where the extraction itself is carried out, is allowed for citizens belonging to the indigenous peoples of the North, Siberia and the Far East, to ethnic communities whose original culture and way of life include traditional methods of protection and use of wildlife objects, and their associations in the territories of traditional settlement and economic activity.
- With a decoy - luring objects of the animal world, classified as objects of hunting, by imitating the sounds they produce or the sounds of other objects of the animal world.
- On the den - getting bears during and in the place of their hibernation.
- On the hole - getting wolves, including puppies of wolves, from their place of refuge, holes.
- From the shelter - the extraction of males of certain species of game birds in the spring.
- With a decoy - the use of a duck to lure a drake in the spring.
- On draft - hunting of game birds during their daily movements or seasonal migrations.
- Scarecrowed - using a mock bird to attract game birds.
Notes:
1. When obtaining objects of the animal world classified as objects of hunting, it is allowed to partially destroy muskrat huts and burrows, open any shelters of small fur-bearing animals, use in the extraction of small fur-bearing animals, foxes, raccoon dogs, badgers, hares, wild rabbits, nets, sleeves and nets, and also to dig narrow wells to the holes of foxes, raccoon dogs and badgers to help hunting dogs. Upon completion of the extraction, the excavated sections of the burrows should be covered with soil.
2. It is allowed to use lighting devices when harvesting wild boars and bears at night from storage sheds in the fields and on feeding grounds from a tower.
3. When catching woodcocks on an evening draft, it is allowed to use pointing dogs, spaniels and retrievers to search for and supply beaten game.

1. These Rules establish the procedure for obtaining objects of the animal world, classified as objects of hunting (hereinafter - objects of the animal world).
2. These Rules do not apply to relations related to the capture of wildlife objects located in specially protected natural areas, as well as the extraction of which is carried out in order to regulate their numbers, scientific, cultural, educational, educational, recreational and aesthetic purposes.
3. The terms used in these Rules mean the following:
a) "acquisition of objects of the animal world" - hunting, including stalking for the purpose of extraction, pursuit and the very extraction of objects of the animal world that are in a state of natural freedom, as well as being in the natural habitat of objects of the animal world with a loaded unsheathed hunting weapon;
b) "tools for obtaining objects of the animal world" - tools defined in accordance with the list of tools for obtaining objects of the animal world, approved by Decree of the Government of the Russian Federation of January 10, 2009 No. 18;
c) "hunting ticket" - a certificate for the right to hunt, confirming that citizens engaged in the extraction of objects of the animal world have certain knowledge of hunting, safety precautions for hunting and handling tools for obtaining objects of the animal world and skills in these areas;
d) "hunting weapons" - hunting weapons defined by the Federal Law "On Weapons";
e) "products of obtaining objects of the animal world" - the obtained objects of the animal world, as well as meat, skins (skins), horns, bird eggs, down, feathers, internal organs and other parts of their bodies obtained from them;
f) "method of obtaining objects of the animal world" - a set of actions aimed at obtaining objects of the animal world;
g) "term for obtaining objects of the animal world" - the established period of time during which certain types of objects of the animal world can be obtained.
4. The following have the right to obtain objects of the animal world:
a) citizens of the Russian Federation who have received a hunting license in accordance with the procedure established by the Ministry of Agriculture of the Russian Federation;
b) foreign citizens who have received permission to harvest wildlife in the manner prescribed by the Ministry of Agriculture of the Russian Federation.
5. The procedure for issuing, replacing and canceling hunting tickets, as well as permits for foreign citizens to obtain wildlife objects is established by the Ministry of Agriculture of the Russian Federation.
6. The extraction of objects of the animal world, the removal of which from their habitat without a license is prohibited, is carried out under a nominal one-time license for the use of objects of the animal world, issued by the executive authority of the constituent entity of the Russian Federation, exercising the powers to protect, control and regulate the use of objects of the animal world and the environment their habitats (hereinafter referred to as the license). The procedure for issuing, processing and the form of a license are established by the Ministry of Agriculture of the Russian Federation.
The extraction of objects of the animal world, the removal of which from their habitat does not require a license, is carried out on the basis of a hunting license in compliance with the norms, quotas and limits for the extraction of objects of the animal world, established in accordance with the legislation of the Russian Federation, within the terms of obtaining objects of the animal world, approved by a government decree of the Russian Federation dated January 10, 2009 No. 18.
7. When obtaining objects of the animal world, persons are required to have a hunting license and a license in the case established by paragraph one of clause 6 of these Rules.
When obtaining objects of the animal world with the use of weapons, persons are also required to have a weapon permit in accordance with the requirements of the legislation of the Russian Federation on weapons.
When transporting products for the extraction of objects of the animal world, it is necessary to have a license with you in the case established by paragraph one of paragraph 6 of these Rules, which is a document confirming the legality of obtaining the specified products.
8. The extraction of objects of the animal world can be carried out both by one person (individually) and by a group of persons (group extraction of objects of the animal world - 2 or more people).
9. In case of group hunting of wild ungulates and bears, the license must be held by the person responsible for group hunting, and in case of individual hunting of wildlife objects - by the person directly carrying out their hunting.
10. Person responsible for the group hunting of wild ungulates and bears:
a) upon receipt of a license, checks the correctness of its execution;
b) before acquiring objects of the animal world, checks with all persons participating in their group acquiring, the availability and validity of hunting tickets and permits of the internal affairs bodies for the storage and carrying of hunting weapons and does not allow persons who do not have these documents to participate in their acquiring;
c) draws up a list of persons participating in the group procuring of objects of the animal world (hereinafter referred to as the list of persons), indicating:
dates and places of obtaining objects of the animal world;
license number, on the basis of which the extraction of objects of the animal world will be carried out;
type of animal world object to be obtained;
last name, first name and patronymic of a citizen participating in the extraction of objects of the animal world;
numbers of a hunting license of a citizen participating in the extraction of objects of the animal world;
numbers of permission of the internal affairs bodies for the storage and carrying of hunting weapons issued to a citizen participating in the extraction of objects of the animal world;
d) conducts briefings with persons participating in the group acquiring of wildlife objects on the safe handling of hunting firearms during group retrieval, as well as the procedure for acquiring wildlife objects, after which the person participating in the group acquiring of wildlife objects signs in the list of persons;
e) during the period of group obtaining of objects of the animal world, has a list of persons with him;
f) after obtaining an object of the animal world, before the start of its cutting and (or) export (removal), makes a note on the extraction and fills out a license;
g) in case of wounding of an object of the animal world, prior to further prosecution, makes a note in the license about the injury and organizes further retrieval of the wounded object of the animal world, for which one day is allocated, not counting the day of injury, otherwise fills out the license, indicating that the object of the animal world was not obtained.
11. A person participating in the group hunting of wild ungulates and bears must have the documents provided for in paragraph 7 of these Rules.
12. In case of group catching of objects of the animal world, not specified in paragraph 9 of these Rules, a list of persons is not compiled.
13. When extracting objects of the animal world, not specified in paragraph 9 of these Rules, the removal of which from their habitat without a license is prohibited, the license is filled before the start of transportation of the products of extraction.
14. In case of individual extraction of objects of the animal world, the removal of which from their habitat without a license is prohibited, the license is filled in in accordance with subparagraph "e" of paragraph 10 and paragraph 13 of these Rules.
15. Cub cubs of the current year of birth and female bears with cubs of the current year of birth are not taken before entering the den.

Training (nataska and nataska) of dogs of hunting breeds is carried out in accordance with the terms of obtaining objects of the animal world, classified as objects of hunting.
Year-round training (training, driving) of hunting dogs is carried out in specially equipped places within the boundaries of territories provided to legal entities or individual entrepreneurs, in accordance with a long-term license for the use of wildlife objects.
17. The executive authority of the constituent entity of the Russian Federation, exercising the powers to protect, control and regulate the use of wildlife objects and their habitat, in agreement with the Ministry of Agriculture of the Russian Federation, has the right to adjust the timing of obtaining wildlife objects within 2 weeks earlier or 2 weeks later than the established deadlines, taking into account changes in the timing of migration and reproductive cycles of animals due to changes in climatic conditions in a particular year.
18. Citizens belonging to the indigenous peoples of the North, Siberia and the Far East, to ethnic communities whose original culture and way of life include traditional methods of protection and use of wildlife objects, and their associations have the right to obtain wildlife objects in the territories of traditional settlement and business activities during the calendar year.
19. Persons guilty of violating these Rules are liable in accordance with the legislation of the Russian Federation.
Changes have also been made to certain legislative acts of the Russian Federation. Thus, the procedure for presenting information on received and issued permits for the extraction of hunting resources has changed. Let's explain the main points.
Who issues permits for the extraction of hunting resources?
Since April 1, 2010, the executive authorities of the subject of the Russian Federation issue permits for the extraction of hunting resources to individuals. And legal entities and individual entrepreneurs who have concluded hunting agreements are provided with permit forms. They then issue these permits to individuals.
The basis is the Federal Law of July 24, 2009 N 209-FZ "On hunting and on the conservation of hunting resources and on amendments to certain legislative acts of the Russian Federation."
There is a procedure for issuing permits for the extraction of hunting resources. It was approved by the Order of the Ministry of Natural Resources of Russia dated April 23, 2010 N 121.
What is included in the permit?
Permits are drawn up and issued by an executive authority, a legal entity, and an individual entrepreneur. The permission states:
- surname, name, patronymic of the hunter;
- data of the main identity document of the hunter;
- the name and organizational and legal form of the legal entity, full name of the individual entrepreneur whose employee is the hunter, contact phone number, postal address and (or) e-mail address by which communication with this legal entity, individual entrepreneur is carried out (information is indicated in case if the applicant is an employee of a legal entity, an individual entrepreneur, who performs duties related to the implementation of hunting and the preservation of hunting resources, on the basis of an employment or civil law contract);
- date of issue of the hunting license and its registration series and number;
- the type of hunting that is supposed to be carried out;
- information about the extracted hunting resources;
- the number of hunted resources;
- dates of hunting and places of hunting.
What documents does an individual provide to obtain a permit?
The issuance of a permit is carried out on the basis of documents presented by an individual. This is a hunting ticket, the main identity document, and a document confirming the payment of the fee for the use of wildlife objects.
What information do wildlife users submit to the tax authority?
Authorities issuing permits shall submit to the tax authority at the place of their registration information on the issued permits, the amount of the fee payable for each permit, as well as information on the timing of payment of the fee. Deadline - no later than the 5th day of each month.
Information is presented in a form. It was approved by Order of the Federal Tax Service of Russia dated February 26, 2006 N SAE-3-21/108@.
In addition, permits to individuals are issued by legal entities and individual entrepreneurs. They are also required to submit information about these permits to the tax authority. The Federal Tax Service of Russia recommends that they submit information in the above form.
Are individuals required to provide information?
There are individuals who use the objects of the animal world. They do not provide information on the obtained permits for the extraction of wildlife objects, the amounts of fees payable, and the amounts of fees actually paid.
What is the procedure for paying a fee for the use of wildlife objects?
Permits for the extraction of hunting resources are issued:
1) to an individual, information about which is contained in the state hunting register, or a foreign citizen temporarily staying in the Russian Federation and who has concluded an agreement on the provision of services in the field of hunting, in cases where he hunts:
a) in assigned hunting grounds - by a legal entity and an individual entrepreneur who have concluded hunting management agreements;
b) in public hunting grounds - by the executive authority of the constituent entity of the Russian Federation;
c) in specially protected natural territories - by nature protection institutions provided for by the legislation on specially protected natural territories.
2) an individual hunter is equated with an employee of a legal entity or an individual entrepreneur who performs duties related to the implementation of hunting and the preservation of hunting resources, on the basis of an employment or civil law contract - by a legal entity and an individual entrepreneur who have concluded hunting management agreements.
The permit is issued on the basis of documents presented by an individual. This is a hunting ticket, the main identity document, and a document confirming the payment of the fee for the use of wildlife objects.
Thus, in the assigned hunting grounds - a legal entity and an individual entrepreneur who have concluded hunting management agreements, permits for the extraction of hunting resources should be issued only if there is a receipt for payment of the fee for the use of wildlife objects.
Legal entities and individual entrepreneurs who have concluded hunting agreements issue permits to individuals. After that, information is submitted to the local tax authorities. This is information about the issued licenses (permits) for the use of wildlife objects. They are issued in the approved form only under section 2 or 2.1 "On licenses (permits) for the use of wildlife objects issued to individuals who are not individual entrepreneurs, the amounts and terms for paying the fee for the use of wildlife objects."
How to return the amount of overpaid tax, dues, penalties, fines?
Upon the expiration of the permit for the extraction of objects of the animal world, organizations and individual entrepreneurs have the right to apply for a offset or refund of the amount of the fee for unsold permits for the extraction of objects of the animal world issued by the authorized body. To do this, contact the tax authority at the location of the authority that issued the permit.
Set-off or refund of fees for unsold permits for the extraction of wildlife objects is carried out in the manner prescribed by Chapter 12 of the Tax Code. For this, relevant documents are submitted. Their list was approved by order of the Ministry of Taxes and Taxes of the Russian Federation dated July 23, 2004 No. SAE-3-21/438@.
Are penalties charged in case of late payment of the fee for the use of wildlife objects?
Payers of the fee for the use of wildlife objects are organizations and individuals, including individual entrepreneurs, who receive a license (permit) for the use of wildlife objects in the territory of the Russian Federation.
Payers of fees are obliged to pay legally established fees, as well as to bear other obligations established by the legislation on taxes and fees.
The obligation to pay the fee must be fulfilled within the time period established by the legislation on taxes and fees. In case of non-fulfillment or improper fulfillment of the obligation to pay the fee, the tax authority sends a demand to the payer of the fee to pay the fee.
Penalty is accrued for each calendar day of delay in fulfilling the obligation to pay a tax or fee.
Penalties may be collected forcibly at the expense of the fee payer's funds in bank accounts, as well as at the expense of other property of the fee payer.
Suppose a legal entity and an individual entrepreneur who have concluded hunting agreements have issued permits for the extraction of hunting resources. At the same time, they were issued without confirmation of payment of the fee for the use of wildlife objects. This is a violation of paragraph 1 of article 333.5 of the Tax Code and paragraph 20 of the Procedure for issuing permits for the extraction of hunting resources, approved by Order of the Ministry of Natural Resources of Russia dated April 23, 2010 No. 121. In case of late payment of the fee for the use of wildlife objects, penalties are charged and levied.

HUNTING RULES IN THE CHELYABINSK REGION

I. GENERAL PROVISIONS
1. These Rules for hunting in the territory of the Chelyabinsk region (hereinafter referred to as the Rules) determine the rules, terms and lists of tools and methods of obtaining objects of the animal world that are classified as hunting objects that are allowed for use.
2. Hunting is a type of use of the animal world, which consists in stalking for the purpose of prey, pursuit and the very prey of wild animals and birds that are in a state of natural freedom.
Being in hunting grounds with weapons, dogs, birds of prey, traps and other hunting tools, or with hunted products, is equated to hunting.
3. Game animals - objects of the animal world (wild animals and birds) living in a state of natural freedom and classified as objects of hunting in the manner prescribed by law.
4. Hunting grounds - all land, forest and water-covered areas that serve as a habitat for wild animals and birds and can be used for hunting and game management.
5. Game animals may be provided to legal entities and individual entrepreneurs for long-term use on the basis of a long-term license and to citizens for short-term use on the basis of a nominal one-time license.
A hunting user is a legal entity, an individual entrepreneur, who, on the basis of a long-term license, is granted the right to conduct a hunting economy within certain boundaries of hunting grounds.
6. The right to hunt on the territory of the Chelyabinsk region is granted to citizens of the Russian Federation, foreign citizens and stateless persons.
Citizens of the Russian Federation enjoy the right to hunt:
1) those who have reached the age of 18, who have a certificate for the right to hunt and a permit to store and carry hunting firearms, issued by an authorized body in accordance with the legislation of the Russian Federation, when hunting with hunting firearms;
2) having a certificate for the right to hunt - when hunting with permitted hunting tools, except for hunting firearms, as well as with hunting dogs and birds of prey;
3) who do not have a hunting license - when hunting wolves, ground squirrels, hamsters, water and barn rats, chipmunks, moles without the use of hunting firearms.

7. Hunting tickets (for foreign citizens and stateless persons - hunting tickets of a foreign hunter) issued by a specially authorized state body for the protection, control and regulation of the use of wildlife objects and their habitat, or membership hunting tickets issued by public hunting organizations, with a mark of these organizations on passing tests according to the rules of hunting, safety precautions for hunting, handling hunting firearms.
A hunting license is issued for a period of five years and is subject to mandatory annual registration with the authorities that issued it until March 31. Without a registration mark, a hunting ticket is invalidated.
7-1. The documents certifying the right to hunt are:
Valid hunting or hunting membership card;
Voucher (nominal one-time license).
A nominal one-time license is a document certifying the right to hunt in the case of the use of wildlife objects, for the use of which the legislation on taxes and fees provides for the collection of a fee.
On the territory of hunting grounds provided for use by legal entities and individual entrepreneurs, the documents certifying the right to hunt include a voucher provided to the hunter by the hunt user.
Hunting users have the right to conclude agreements with legal entities and citizens for the use of game animals by them with the simultaneous issuance of registered one-time licenses.

8. When hunting, traveling to and returning from hunting grounds, as well as when transporting hunting products, the hunter must have a valid hunting or membership hunting ticket and a permit (nominal one-time license), and in the presence of firearms - permission from the internal affairs bodies the right to keep and carry these weapons.
Foreign citizens and stateless persons, when hunting in the Chelyabinsk region, are required to have a hunter's identity document, a hunting ticket of a foreign hunter and a permit (nominal one-time license) and, in the presence of a weapon, documents provided for by the legislation of the Russian Federation.

9. The hunter is obliged to present for verification the listed documents, as well as weapons and other hunting tools, vehicles, hunting products at the request of officials of the bodies authorized in the field of protection, control and regulation of the use of wildlife objects classified as hunting objects, and their environment. habitat, authorized executive bodies of the Chelyabinsk region, internal affairs bodies (police), bodies for the protection of the territories of state nature reserves and national parks.
10. Employees of legal entities, individual entrepreneurs engaged in hunting, scientific organizations, expeditions and other persons sent to hunting grounds on official business, during periods closed for hunting, may be in the grounds with hunting firearms and other hunting tools only on special permits issued by a specially authorized state body for the protection, control and regulation of the use of wildlife objects and their habitat.
11. Upon receipt of a voucher (nominal one-time license), the hunter is obliged to clarify the boundaries of the hunting ground and is responsible for their violation.
The hunter is not responsible in case of unintentional transition to adjoining lands in places where this boundary is not clearly expressed on the ground and does not have full houses.
12. The hunter is obliged to comply with the norms of hunting animals and the terms of hunting specified in the nominal one-time license.
13. The hunter is obliged to return nominal one-time licenses to the place of their issue, making a note about the results of the hunt. Nominal one-time licenses are returned or sent by mail within five days after their expiration date.

14. The sighting of firearms and hunting weapons is carried out at specially equipped shooting ranges or sites.
In hunting grounds, shooting is allowed only during the hunting period if the hunter has documents for the right to hunt. When sighting, the hunter is obliged to observe safety measures that exclude the possibility of causing harm to a person or animal.
15. It is prohibited to capture and keep in captivity wild animals classified as objects of hunting without special permission from a specially authorized state body for the protection, control and regulation of the use of objects of the animal world and their habitat.
16. Harvesting of wild animals and birds classified as objects of hunting for scientific, cultural, educational, educational, recreational and aesthetic purposes is carried out with special permission from the specially authorized state body for the protection, control and regulation of the use of objects of the animal world and their habitat.
II. PROHIBITED GUN AND HUNTING METHODS
17. On the entire territory of the Chelyabinsk region it is prohibited:
1) the use of small-caliber rifled hunting firearms chambered for lateral fire for any hunting;
2) harvesting of wild ungulates and brown bears while crossing water bodies or using trappers;
3) the use of hooks, pneumatic weapons, bows, crossbows, hunting pits, wary guns and other generally dangerous self-traps in hunting;
4) the use of hunting firearms that are not registered with the bodies of the Ministry of Internal Affairs of the Russian Federation during hunting;
5) shot shooting at wild ungulates and brown bear, as well as shot shooting at brown bear, elk;
6) the use of nets, vents, loops, tents, hooks when hunting, as well as the use of loops when hunting a bear and wild ungulates;
7) the use of any types of chemicals, explosives in the extraction of wild animals, with the exception of odorous baits;
8) the use of tape recorders and other electronic devices reproducing sound during hunting;

10) the use of motorized vehicles for the pursuit and production of any kind of animals, as well as shooting from all motorized vehicles, with the exception of shooting from floating vehicles with the engine turned off;
11) collection of eggs and destruction of nests of wild birds, destruction of beaver dams, destruction and excavation of permanent dwellings of fur-bearing animals and badgers;
12) installation of devices for silent shooting and night sights on hunting firearms; (see the text after the Rules of hunting C / o)
13) the use of leg-grasping traps, with the exception of cases of hunting beaver, wolf, ermine, raccoon dog, column, marten, fox, mink, muskrat, lynx, polecat, stray outbred dogs and cats;
Note: in the production of legal hunting, it is allowed:
partially destroy muskrat huts and burrows;
open any shelters of small fur-bearing animals;
when hunting small fur-bearing animals, foxes, raccoon dogs, badgers, use small nets (nets, sleeves, nets) with the direct participation of the hunter;
to dig narrow wells to the holes of foxes, raccoon dogs, badgers in order to help the dogs working in the hole. After hunting, the excavated areas of holes should be covered with soil.
18. Citizens of the Russian Federation, foreign citizens and stateless persons who hunt on the territory of the Chelyabinsk region are prohibited from:
1) being with a loaded weapon in populated areas;
2) shooting at a distance closer than 100 meters from housing;
3) participation in hunting or being in a state of alcoholic intoxication with collected weapons;
4) battue shooting along the shooting line, in which the trajectory of the projectile passes closer than 10 meters from another shooter;
5) being on any motorized vehicles with a loaded firearm, or with a firearm with equipped magazines (with the exception of hunting from boats, boats with the engine turned off);
6) transportation of collected unsheathed firearms on any motorized vehicle, except for cases of collective hunts for wild ungulates;
7) transfer of nominal one-time licenses for the production of game animals to another person;
8) being in hunting grounds with rifled weapons without a valid nominal one-time license for the extraction of wild ungulates and a brown bear; (see the text after the Rules of hunting C / o)
9) transportation of hunting products without relevant documents confirming the legality of their origin, as well as products obtained by other hunters;
10) export, transportation of meat, skins, carcasses and other products from harvested wild animals, the seizure of which is carried out on the basis of nominal one-time licenses with an empty reverse side of personal one-time licenses or without a coupon for these licenses;

11) destruction or damage of signs defining the boundaries of specially protected natural areas, as well as signs established by users of wildlife or a body authorized in the field of protection, control and regulation of the use of wildlife objects classified as hunting objects, and their habitat, buildings and other facilities belonging to the specified users and authorities;
12) to obtain game animals, for the use of which the legislation on taxes and fees provides for the collection of a fee, without a nominal one-time license, or violate the conditions provided for by a nominal one-time license, as well as arbitrarily assign the rights to use wildlife objects classified as hunting objects.

III. HUNTING WITH DOGS
19. When hunting for searching, chasing and catching wild animals and birds, it is allowed to use dogs.
20. All dogs that are with a citizen in the hunting grounds must be included in the hunting ticket or have a certificate of registration with the veterinary authorities.
21. It is allowed to use cops and spaniels on woodcock traction for searching for wounded animals and feeding birds.
The use of other breeds of dogs for spring hunting is prohibited.
22. All-the-year-round driving and driving of hunting dogs is allowed in specially designated areas of land. The number and boundaries of sites, the rules for their use are established by hunting users in agreement with the specially authorized state body for the protection, control and regulation of the use of wildlife and their habitat.

IV. HUNT FOR WILD UNGATES
27. Hunting for wild ungulates is carried out under registered one-time licenses, which during the hunt must be in the possession of the person responsible for shooting (senior team, foreman).
28. Harvesting of wild ungulates is permitted within the following periods:
Siberian roe deer:
all sex and age groups, with the exception of adult females with offspring of the current year of birth - from September 1 to December 31;
29. Responsible for shooting (team leader, foreman) is obliged to:
1) upon receipt of a nominal one-time license, check the correctness and completeness of filling in all columns of the front side of the license;
2) before the hunt, check with all members of the team (team) the availability and validity of hunting tickets and permits of the internal affairs bodies for firearms and not allow persons who do not have the necessary documents to participate in the hunt;
3) draw up a list of participants in the hunt indicating the date of the hunt, numbers of licenses under which the hunt will be carried out, the type of animal to be shot, the last names, first names, patronymics of the hunters participating in the hunt, numbers of hunting tickets, organizations that issued the ticket;
4) conduct a safety briefing and the procedure for conducting a hunt and ensure that all hunters sign the list of participants in the hunt, which is also a safety briefing sheet;
5) after shooting the animal, before the start of export or cutting of the carcass, fill in the reverse side of the nominal one-time license;
6) in case of wounding of the animal (blood appeared on the trail or there are other signs of being hit), before the start of further pursuit, make a note about the wound in the license and organize the collection of the wounded animal, for which 1 day is allotted, not counting the day of injury;
7) return a nominal one-time license to the place of its issue or send it by mail.
30. When chasing a wounded animal, it is allowed to cross the borders of the farm and enter the hunting grounds adjacent to the place of shooting, having previously made a note about the injury in the nominal one-time license.
V. BROWN BEAR HUNTING
31. Hunting for a brown bear is carried out under a nominal one-time license, which during the hunt must be in the possession of the person responsible for shooting (senior team, foreman).
33. When hunting a bear, the person responsible for shooting is obliged to comply with the requirements of paragraphs 29 and 30 of these Rules.
2 days are allotted for the recovery of a wounded animal, not counting the day of injury.
34. It is prohibited to shoot female bears with cubs of the current year of birth before entering the den.
35. When hunting in a den, if there are several animals in one den, the hunter can shoot all the animals with the subsequent issuance of additional licenses.
VI. FUR HUNT
36. The extraction of fur animals, for the use of which the legislation on taxes and fees provides for the collection of a fee, is carried out under nominal one-time licenses.

37. Harvesting of fur-bearing animals is permitted within the following deadlines:
ground squirrel, hamster, water rat - without limitation;
American mink, Siberian weasel, squirrel, lynx, marten, ermine, polecat, weasel - from October 15 to February 28 (29).
39. Hunting for hares is allowed from November 1 to January 31. Hunting for hares and foxes with hounds and greyhounds that have a certificate or certificate of origin is allowed from October 15th.

VII. FEATHER HUNTING
44. The extraction of game birds, for the use of which the legislation on taxes and fees provides for the collection of a fee, is carried out under nominal one-time licenses.

45. Spring hunting is allowed for a period of not more than 10 days for all types of hunting at the same time.
46. In the spring, the following types of hunting are allowed:

on geese from hiding.
47. The list of types of hunting and specific terms of spring hunting are established before each hunting season by the Government of the Chelyabinsk region in accordance with these Rules.
48. Summer-autumn hunting for swamp, upland, waterfowl and field game is established from the dawn of the fourth Saturday of August to October 31.
Summer-autumn hunting with cops and spaniels with a certificate or certificate of origin for swamp, upland and field game is allowed from the second Saturday of August.

VIII. HUNTING WITH BIRDS

Available in the Model Rules for Hunting in the RSFSR, which are in force in the Russian Federation, the ban on the use of small-caliber rifled hunting weapons chambered for side fire for amateur and sport hunting throughout the entire territory of the RSFSR contradicts the federal laws "On Weapons" and "On the Wildlife" that have been put into effect .
By decision of the Supreme Court of the Russian Federation No. N GKPI07-385 clause 22.1 The Model Rules for Hunting in the RSFSR regarding the ban on the use of small-caliber rifled hunting weapons chambered for side fire for amateur and sport hunting throughout the entire territory of the RSFSR was declared invalid and not subject to application from the date the court decision entered into force. Decree of the Cassation Board of the Supreme Court of the Russian Federation dated November 20, 2007 No. N KAS07-581 decision of the Supreme Court of the Russian Federation of 13.08.2007 N GKPI07-385 was left unchanged and entered into force.
In accordance with Art. 3 of the Federal Law N 184-FZ of 06.10.1999 normative legal acts of the constituent entities of the Russian Federation shall be brought into line with federal legislation within three months from the date of the relevant changes that have occurred in the legislation of the Russian Federation.
