If all the disabled spaces are occupied. What people don't understand when they take up disabled parking

In order for a disabled person to take advantage of the benefit and park for free, he must obtain a special disability permit. However, he can leave the car without spending money only in a specially designated place. If all such spaces are occupied, and he parks in a regular one, he will receive a fine.

What should a disabled person do if he came somewhere on business, but everything special places are you busy? Apparently, you can park nearby in a regular paid space and go about your business. But no. First you need to pay general principles for parking: 80 or 50 rubles per hour. After all, if you don’t pay, then the disabled person also receives a fine of 2,500 rubles on a general basis. It also turned out that if ordinary person parks in a parking lot for the disabled, he will receive a fine, even if he pays for parking.

And there are already such precedents. The owner of one car received a disabled permit, but left the car on usual place(because everything disabled parking were busy) for which she received 9 fines totaling 22,500 rubles. So what kind of concern for disabled people is this? The AMPP (Parking Space Administrator) confirmed the situation, there is no error.

That is, if a disabled person finds that all special spaces are occupied, he must ride in circles until a space is free, or park on a general basis for money.

This is attention to the disabled, you can’t say anything. By the way, no one warns about this, of course, when a permit is issued. Why? After all, in this way you can earn money not only from ordinary drivers, but also from disabled people. It has been said more than once that even residents who have signed up for a parking pass in their area often receive fines.

Either this is a disregard for citizens, or this is a completely conscious policy of the Parking Space Administrator in order to collect more money. Only you can draw conclusions, but do not forget that it is this organization that, in addition to paid parking, also controls

Since 2012, car parking in the center of Moscow has been paid service. But there are some categories of citizens who have the right to do this for free. This includes people with disabilities. What are the parking rules in Moscow for people with disabilities? Let’s find out in more detail.

But the same parking rules in Moscow for people with disabilities indicate that when occupying a space that is not intended for citizens of this category, that is, one that does not have special markings, he must pay for it on a general basis.

When parking in a space intended for parking vehicles belonging to disabled people, the driver must have documents confirming this fact. This can be either a standard certificate or a certificate. A special sign pasted on glass is not evidence of disability. On the other hand, its presence or absence is left to the discretion of the car owner. By law, the presence of this sign on a vehicle is not required.

Who else can use free parking?

There is another category of citizens who can take advantage of such a benefit as parking for the disabled in Moscow. The rules permit the use of these places by those transporting persons belonging to this group. Drivers who are not disabled, but who regularly transport them or accompany disabled children, may place a sign on their vehicle and occupy a designated parking space vehicles belonging to citizens with disabilities. This is only possible during the transportation of a disabled person who has supporting documents with him. In all other cases, Moscow parking rules for disabled people consider the presence of a sign on a car to be illegal.

  • his contact details or the contact details of his representative;
  • information about place of residence;
  • car data (make, registration number);
  • term and date of disability;
  • indication of the preferential category;
  • validity period and registration number of the parking permit.

For which vehicle can a permit be issued?

The parking rules for disabled people in a paid parking lot also stipulate the requirements for a car for which a permit can be issued. To do this, he must meet several conditions.

  1. The vehicle is owned by a citizen with a disability.
  2. The car belongs to the person who is the legal representative of the disabled child.

Penalties for parking lot owners

Despite the fact that they lose part of the profit, owners of paid parking lots are required to allocate the number of parking spaces that provide for parking rules for group 2 disabled people in Moscow. However, disabled people of group I have the same rights. Compliance with this is monitored by the Code of Administrative Offenses of the Russian Federation. In case of non-compliance with these rules, Article 5.43 comes into force, which provides for penalties for the absence of parking spaces intended for citizens with disabilities. For individuals this can cost from 3 to 5 thousand rubles. Organizations will pay a fine of 30 to 50 thousand. Faced with such a choice, owners prefer to allocate and equip the necessary places rather than pay such amounts.

Fine for illegal use of parking

Despite the fact that the parking rules for Moscow quite clearly describe those categories of citizens who can take advantage of free spaces, it sometimes happens that they are occupied by cars of those who are not included in the outlined circle of people. Even if you don't consider ethical side This question - you must agree, it is not very nice to take the place of those for whom covering extra meters often causes great difficulty - such an action can bring quite tangible troubles for the violator. The same provides for a fine of 5 thousand rubles in case of unlawful occupation of a parking space intended for a disabled person’s vehicle. By the way, this is the most large sum for wrong parking. Those who like to occupy other people's places are also at risk because traffic police officers usually monitor such parking lots very closely. After all, in order to issue a fine you need so little: wait for the inattentive or impatient driver to stop in a place with markings showing that this parking space is intended for a disabled person’s vehicle, take a photograph of the violation? gjckt xtuj you can issue a receipt.

And finally, I would like to note, gentlemen drivers, let's remain human! Yes, it often happens that free seats All that remains is parking for disabled people in Moscow, the rules of which can either be violated, or you will have to park at a considerable distance from the purpose of your trip. But for a healthy person it is not very difficult to overcome the extra 100, 200, 300 meters. When occupying a parking space intended for a car of a person with disabilities, remember that it is much more difficult for him to overcome this distance.

According to current Russian legislation, disabled people are people who, due to physiological, intellectual, and mental disabilities, have limitations in their full life activities. Modern state and society strive to make their lives easier, but there are unscrupulous people who seek to take advantage of the benefits of disabled people, pushing aside those who are truly in need and making it difficult to function. This particularly applies to parking.

Benefits

Disabled people have a number of benefits. This general practice all over the world, and in our country in particular. Disabled drivers are also entitled to certain benefits, for example, in parking. This situation causes outright dissatisfaction among some people.

But people with disabilities are not deceivers who received the right to free parking “through connections”; they receive their benefits for specific illnesses and health deficiencies. Healthy man without hesitation, he will walk hundreds of meters, while disabled people cannot walk even a few steps. That is why such categories of citizens are entitled to certain benefits. Violators should think about this normal health, breaking the law and parting with a certain amount of fine for parking in a disabled person’s space.

How many parking spaces are allocated for disabled people?

Parking is a scourge for motorists. The ever-increasing number of cars in Russia, as a rule, is poorly compensated by the increase in parking areas. And therefore parking, especially in the center of a large city, is an excruciating pain for drivers, including disabled people.

True, in this regard the state meets certain categories of people halfway. Usually special parking for disabled people is located at minimum distance from the entrance. The state requires special parking spaces for disabled people in car parks. The place where parking for disabled people is located is indicated by a special sign.

According to current legislation, parking lots located near specialized institutions where this category of citizens visit must have approximately 10% of the area exclusively for disabled people. Near hospitals dealing with diseases of the musculoskeletal structure, the percentage of specialized places is even higher and should be 20%.

How are disabled parking spaces designated?

Signs indicating parking for vehicles of disabled people are located no further than 50 m from medical structures and other institutions. Areas for cars of disabled people and their accompanying persons are marked with markings and a special sign in accordance with traffic regulations.

The “Disabled Parking” designation is divided into two parts. The first is a regular parking sign: written white letter"P" on a blue background. Area - 70 cm by 70 cm. Under the sign there is a sign: wheelchair, there is a person on it. Area - 35 cm by 70 cm.

Violation of these rules is punishable by a fine. Moreover, the fine for parking in a disabled spot is quite large.

Problems with the “Disabled” sticker

Traffic police inspectors have to ask people with disabilities without obvious symptoms of disability to indicate their status. At the same time, a considerable number of drivers stick a warning sign on their car so that they can easily occupy seats for the disabled. Therefore, just in case, you need to take documents with you.

And, by the way, disabled people are not required to attach a warning sign to their car. This requirement is not in the law. The sign is assigned only voluntarily.

But since the law does not stipulate that the sign must be present, many violators pretend to be disabled people in order to occupy a “preferential” parking space. Because of this, parking spaces near shops or government agencies occupied by violators. Some even buy fake disability documents.

To detect deceivers, you need to turn to law enforcement agencies. The following events will be held there:

  1. They will check your disability certificate.
  2. The request will be forwarded to the Pension Fund.
  3. Archives with the necessary data will be processed.
  4. When a violation is discovered, the culprit will face a criminal case and even prison for using a false document.

In addition, the traffic police inspector will decide what fine to issue to the violator for parking in a disabled person’s space.

Fines for parking in a disabled space

Drivers who park in a disabled space will be fined. What is the fine for parking in a disabled spot? The monetary penalty is at least 5 thousand rubles.

Benefits for disabled people in parking lots are either unwittingly or deliberately violated. Since disabled people themselves are unlikely to be able to resist, the state seeks to protect their rights. For violations of parking in a space for disabled people in 2017, a fine must be paid in the following amount (according to the Code of Administrative Offenses of the Russian Federation):

  • for an individual - 5 thousand rubles;
  • for an official - from 10 to 30 thousand rubles;
  • institution, legal entity - from 30 to 50 thousand rubles.

In addition, the offender’s car is immediately transported to the penalty area, and the owner can return it only after paying the fine.

A disabled person is not subject to a fine for parking in a regular space. Disabled people can use benefits, but at their own request.

Why have fines increased so much since 2011?

Small fines (200 rubles) have attracted serious criticism for several years. Indeed, such a sum did not bother the violators at all, especially in major cities, Where wages was an order of magnitude higher. Violations of the rights of people with disabilities were widespread, and places were not occupied for their intended purpose. Therefore, due to parking in a disabled space, the fine has been significantly increased since 2016. Monetary punishment increased 24 times.

In 2017, traffic police fines for parking in a disabled person's space are not expected to increase. Although, it must be said, the number similar violations growing again.

Detention and evacuation of the violator’s vehicle to the impound lot

The list of situations where evacuation of a car to an impound lot is used as punishment is noted in Art. 27.13 Code of Administrative Offenses of the Russian Federation. Mainly, they are divided into several groups:

  1. Due to the fault of a driver who violated safety rules or drove a vehicle without documents.
  2. Problems with the vehicle and/or cargo.
  3. Violation of traffic rules while traveling or parking.

These violations allow the traffic police inspector to send the car to the impound lot. In doing so, he must perform the following actions:

  • write a detention report in two copies;
  • the violator must sign or refuse to sign the protocol;
  • During registration, witnesses must be present or videotaped;
  • the protocol must indicate all formal marks;
  • All access points to the vehicle are sealed.

How to check and pay fines imposed

There are different ways to check the fine for parking in a disabled space:

  1. A letter with information about the fine is sent to the car owner at his place of registration within three days from the registration of the violation.
  2. Data on fines can be checked using your own documents or the car number at the traffic police department.
  3. Via the Internet. You need to go to the State Services website, where there is information about fines for parking in spaces for disabled people. You can also look at the traffic police website.
  4. Through the court. If the bailiffs have information about the fine, they will receive a summons.

You can also pay for fines in several ways:

  • through a banking institution;
  • via ATM;
  • through online services (for example, Yandex.Money allows you not only to pay fines, but also to check their availability; you can also pay through Sberbank Online or Qiwi).

If after five to ten days the fine is still listed as unpaid in the traffic police database, you need to send a receipt for payment electronically through the official website of the structure. It may make sense to go to the branch in person with a receipt.

How to appeal an unlawful punishment

You can challenge a fine for parking in a disabled space if you believe it was imposed inappropriately. Within 10 days from the date of transfer or receipt of a copy of the decision, you must draw up and send a complaint addressed to the chief inspector. When the time for appeal has passed, you can try to win a few extra days by pointing out the delay in receiving the document. You need to file a petition.

The decision to fine can be appealed in court. This will take about 2 months. If you win, you can expect not only a refund of the fine, but also the cost of towing the car.

These actions will be correct when there is serious evidence of absence of guilt, for example, photographs, videos, etc.

Is it possible to reduce the fine for illegal parking?

When the inspector has already detained the driver and a fine is certain, then all that remains is to try to reduce the fine. What is needed for this:

  • do not be nervous and do not conflict with the inspector - a simple rule that many people forget about;
  • remember your rights; if you hesitate, ask to submit the necessary data to the traffic rules or the Code of Administrative Offenses;
  • if a disabled person disembarks and leaves, but can return and show a document, you need to call him, as a rule, the inspector will agree to wait;
  • if the driver is at fault, then when drawing up the protocol you need to be careful and watch what you sign;
  • if you intend to appeal the inspector's decision, write in the appropriate column about your disagreement, in addition, demand that you write about yourself in the protocol as the “driver” and not the culprit.

When receiving a fine for parking in a space for disabled people, a legal entity can try to prove that it is an individual, thereby reducing the amount of the fine to the smallest amount of 5 thousand rubles.

How can disabled people benefit from free parking?

To obtain the right to free parking, you must have a parking certificate, which is provided to all residents of our country, and documents certifying your disability.

  2. "Deaf Driver" - yellow circle 16 cm in diameter, inside which three black dots form a triangle.

The installation of these signs is voluntary. But strictly defined categories of citizens can use them.

Who can stick a “Disabled” sign on the car window?

The persons transporting them, as well as the parents of disabled children, also have the right to do this.

The driver of a car with a “Disabled Person” sign, in addition to his license, vehicle registration certificate and insurance, is required to carry with him “a document confirming the fact of disability” (Resolution of the Russian Government of January 21, 2016).

When stopped by a traffic police inspector, a disabled driver or a driver transporting a disabled person must present the original of one of these documents. Copies, even notarized ones, are not accepted.

Cars with “Disabled” signs installed on the windshield and rear windows are not subject to a number of prohibitory signs (Section 3 of Appendix 1 of the Traffic Regulations):
  • "Movement Prohibition";
  • “The movement of motor vehicles is prohibited”;

There are two reasons:
  1. The most convenient parking spaces are allocated for drivers and passengers with disabilities.
  2. Parking for disabled people is free.

Previously, parking spaces for the disabled were occupied by all and sundry. A fine of 200 rubles did not frighten anyone. In 2016, the legislation was tightened, and unscrupulous motorists began to carry it in the glove compartment just in case. yellow sign with a wheelchair user. (It is sold absolutely freely and costs mere pennies.) It is unlikely that the inspector will wait for several hours for the driver to check the documents.

But what bigger city And the problem is more acute with parking, the more inventive motorists are. In Moscow, cars with the “Disabled” sign are entered into a separate register, and their owners are issued special parking permits. They give the right to stand as long as necessary, even on paid parking. For this reason, car owners buy fake disability certificates.

What threatens those who illegally use the “Disabled” sign and parking lots for people with disabilities?

Violators face fines. In the Code Russian Federation There are three articles about administrative offenses about this:
  1. Article 12.4 on the illegal installation of the “Disabled Person” sign. Fine - 5,000 rubles for individuals, 20,000 rubles for officials and 500,000 rubles for legal entities. Plus the removal of the sign itself.

  3. Part 2 of Article 12.19 on violation of the rules for stopping and parking vehicles in places for disabled people. Fine - 5,000 rubles.
